There has been a lot of talk about them lately, and many are asking how exactly they work. An infidelity clause is usually part of a prenuptial or post-nuptial agreement and ensures that if one party is caught in an affair, the other party will pay a financial award. While it seems to be a sound preventative measure, there are drawbacks, including a heightened priority of being able to legally prove the existence of an affair in court, as well as the potential to cause a rift in an otherwise good relationship by undermining trust.
